It's now the Law!

On July 31, 2004 the Massachusetts Legislature passed a law mandating a minimum of 10-hours of OSHA safety training for all who are employed on a public job site.  That means project managers, superintendents and engineers as well as trade workers.

The law in part says that employers must certify that they are "able to furnish labor that can work in harmony with all other elements of labor employed or to be employed on the work; that all employees to be employed at the worksite will have successfully completed a course in construction safety and health approved by the United States Occupational Safety and Health Administration that is at least 10 hours in duration at the time the employee begins work and who shall furnish documentation of successful completion of said course with the first certified payroll report for each employee; and that he will comply fully with all laws and regulations applicable to awards of subcontracts subject to section 44F.

SECTION 5. This act shall take effect on July 1, 2006.

Don't Be Surprised...

  • If you are prevented from bidding on a job because you can't furnish "the OSHA recorded registration number" only issued to construction workers who have successfully completed the now mandated 10 hour safety training.
  • If you lose a contract because you are unable to provide "the OSHA recorded registration number" only issued to construction workers who have successfully completed the now mandated 10 hour safety training.
  • If you are cited for a safety violation simply beause a worker on site could not present his or her "OSHA issued training completion card" that is only issued to construction workers who have successfully completed the now mandated 10 hour safety training.
  • If your insurance rates increase because you don't have an "OSHA recorded registration number" for every employee, (including sub-contractors and independent contractors) that is only issued to construction workers who have successfully completed the now mandated 10 hour safety training.
  • If a building inspector shuts down your job because your workers can't furnish "the OSHA recorded registration number" only issued to construction workers who have successfully completed the now mandated 10 hour safety training.
  • If very soon you are unable to pull a Building Permit because you can't furnish "the OSHA recorded registration number" only issued to construction workers who have successfully completed the now mandated 10 hour safety training.
  • If you can't get your workers trained in a timely manner because OSHA Outreach Construction Industry Safety Training Sessions are over subscribed due to high demand and limited class availability.
  • If several companies go out of business because they did not ...
